Learning About Legal Negligence Examples

Legal negligence refers to the inability or failure of a professional to do something the way it is supposed to be done by that professional. It happens all too often in the world today and it can have devastating effects on your career, your reputation and your finances. For this reason, I have put together this short article on legal negligence examples. At the very least, it should serve as a good introspection into this complex subject. At worst, hopefully it will give you some ideas on how to best deal with this situation if it ever comes up.

A legal negligence example, I recently heard about involved a lawyer who represented an oil and gas company that drilled into a reservoir. While the man who caused the spill was supposedly doing everything he could to keep the site dry, another lawyer for the company sent him a text message saying “keep quiet”. What followed was an investigation by the Texas Railroad Commission (TTCC) which ultimately found that the man actually did not know what he was doing and never asked for permission to drill into the reservoir. He later received a hefty fine and later admitted to the charges. Not exactly the best legal negligence example you would want to follow.

Perhaps one of the most common results of legal negligence is the case of Blackwater Creek v. Thibault. This is where a Texas oil man was found to have given mixed messages to his workers about the safety procedures they needed to follow when working in the oil field. When the workers did not follow the directions he gave them, they suffered injury. In this case, the employer was found not to have complied with the legal negligence laws in place at the time. In short, he was found to have failed to provide adequate safe working conditions for the people he was leading to.

The second legal negligence example I have listed for you concerns an attorney. A young attorney named Matthew McCaleb was found guilty of malpractice for failing to adequately advise a client on the proper medical treatment for her cancer. Due to his lack of medical training, he failed to give her the correct treatment for her disease. In addition to the actual malpractice, he also failed to provide enough guidance to the client about the various options she had available to treat her cancer. Because of these factors, she died from the disease.

One more legal negligence example involves a man who caused death to a deer during a hunting trip. The hunter, Robert Youngerman was not wearing the proper safety equipment when he led his group into an area where they were expected to shoot a deer. Because of this, the deer he was aiming at choked to death on his antlers. Because the court found that his conduct caused the accident, he was given a monetary settlement by the victims of his negligence.

So how do you avoid committing another legal negligence example? First, if you are planning to work with animals, it is important that you learn how to properly handle them. Animals can be as unpredictable as the weather; they may get scared, lose their appetite or get sick. For this reason it is important that you always keep them safe and healthy by ensuring that they are fed properly and that they have regular vet care. If you fail to do this, you could be found liable for animal cruelty.

Next, you should never attempt to handle dangerous animals on your own. You should also have proper training to do so. Any attempt to do so may lead to serious injury or even death. It is a good idea to consult a lawyer if you have run into any legal negligence example involving animals. Although the lawyer may not be able to stop your negligence in the short term, he or she will be able to do everything possible to help you fight against it in the long term. This will mean that you can save yourself a great deal of money that would have been spent paying medical bills and legal fees.

In some cases, a legal negligence example can occur because an employer fails to provide workers with the proper safety equipment. For this reason, you should always make sure that you are wearing the proper safety gear. If you do not feel comfortable wearing these items, then it may be best to simply not wear them. There are also plenty of other items that you can invest in that will help ensure that you are not injured when you are working. By making sure that you are as safe as you can be, you will be able to work safely at all times and therefore reduce the chances of being found liable in case of an accident.
