Medical Conditions: One of the most common types of legal waivers examples is a request for a hardship exception. In this example, a person is asking for an exception to a standard DUI law requirement, based on their particular medical condition. A standard DUI provision requires that any driver with a serious medical condition take a drivers assessment and get a DUI evaluation before they are given a Class A or B DUI citation. In some cases, a DUI can be issued at the instance of the discovery of a serious medical condition, even if the condition has existed for more than one year.
A hardship exception, therefore, is a request that a legal waiver be presented so that the person who must take a blood or breath test can be exempted from doing so. The legal waiver in this example, or any other for that matter, is usually called a Hardship Exemption. An appropriate situation for a hardship exemption might be where a person with a serious medical condition that gets worse while they are driving becomes too risky for them to drive. They have determined that even without the medicine, they would still face difficulty in completing their errands or staying ahead of their friends in a traffic situation.
Durability/Resistance: Another example of a legal waiver example is one that deals with resistance to a compulsory roadside sobriety test. The wording of such a waiver could cover a number of situations. It could indicate that the person must take my law examination when they have been drinking or they have a blood alcohol content level that is the legal limit in their state of residence. It could also indicate that they must take the examination even if they have had a drug-related incident within the past seven years or if they were the subject of a police stop and took a breath or a blood test while they were driving. Such examples might be the result of an accident or the result of being accused of a crime that they did not commit.
No-Fault Waivers: A third legal waiver example concerns situations where the insured individual has been driving without the proper form of insurance coverage for some period of time. They might have obtained coverage but have failed to disclose the fact that they are suffering from a medical condition. Such a condition could lead to a claim being filed against them. Such a no-fault waiver could also be used in scenarios where the insured individual needs to take a prescribed medication for a condition. This could be due to a doctor’s recommendation or it could be because of a real life condition that has arisen and has required the medication.
In these cases the insured must obtain and sign a legal waiver form. Such a form should include a detailed explanation as to why the doctor recommended the medication and that the condition that required the medication is a genuine one. The legal waiver example has to provide a complete history of the medical condition. For example, the last three pages of the prescription must show that the medicine has been prescribed to the patient for a period of one year. If the medication was for some other medical condition, it should also provide proof that it has been dispensed to that patient on a regular basis.
Once the legal waiver has been signed, the insured must carefully read the document over again. They must understand each provision of the waiver carefully. If they do not understand every word or phrase in the document, they should consult with a legal representative. The representative will ensure that the condition is specifically addressed and the reasons for the request are justified. The physician involved may also want to discuss some aspects of the medical treatment with the patient and so will have their consent to the document reviewed as well.
It is advisable for patients to be involved in the drafting of legal waivers. They can suggest improvements or changes to the document that will make it more acceptable to their insurer. This will increase the chances of the insurance company accepting the request. However, it is vital that they understand and fully agree with the medical advice provided and that they execute the legal waiver example completely.
